Kenya's Gambling Regulatory Authority's takeover nears
Kenya is on the cusp of a transition period of less than three weeks before the Gambling Regulatory Authority (GRA) takes over from the Betting Control and Licensing Board. The transition marks the end of an era for the current regulatory body, which has controlled the gambling industry in the country for decades. The industry operators are now presented with a short period to prepare to comply with the new rules and stricter regulatory policies.
Operators in Kenya are therefore advised to review their compliance mechanisms and improve their systems before the transition to the new regime. The new system will be governed by the Gambling Control Act, 2025, which is designed to provide stricter oversight and accountability. Industry players are viewing the transition as a challenge and an opportunity to improve the professionalism of the gaming sector.
Licensing pauses during handover
The transition period is to end by 28 February 2026. The authorities are to announce the formal commencement of the GRA and the licensing activities publicly. This formal announcement will confirm when the applications can be made to the new administration. For now, all applications are suspended. Operators are experiencing a temporary period of confusion if they are seeking a license or an extension to an existing license.
However, the authorities argue that the suspension is to ensure a clean break from the past regime to the new regime. The Betting Control and Licensing Board explained: “The transition to the Gambling Regulatory Authority is a critical step towards a modern, robust and responsible regulatory framework.” The authorities argue that the new system will provide better and stricter oversight and improve the integrity and confidence in Kenya’s gaming sector.
Operators urged to gear up
Legal consultant Caiphas Chepkwony has encouraged operators to take action rather than waiting to be informed by official communications. According to Chepkwony, operators should prepare to take action by keeping a close eye on announcements regarding compliance changes. “Operators need to monitor official communications from the GRA for updates on the development and publication of the new regulations,” he stated. This statement shows how critical it is to be informed during the transition period. In addition to this, he stated regarding compliance:
“Operators must review existing compliance structures to align internal policies with anticipated requirements of the Gambling Control Act, 2025. Plan for potential changes to licensing and operational requirements once the GRA’s new regulatory framework is enacted.”
Digital platforms under increased scrutiny
Authorities have stated that digital and online gambling sites are likely to be under closer scrutiny under the new system. This directive follows the introduction of stricter regulations regarding player protection, financial guarantees, and responsible gambling. This change has been made to address some of the risks related to the fast growth rate experienced by online gambling sites. It may require operators to upgrade their sites to be more compliant with regulations.
Leadership takes shape
The leadership structure at GRA is also changing as the transition process gains traction. President Ruto appointed Mr. Joseph Kirui Limo, a former member of Parliament, as the Non-Executive Chairperson of the GRA, with his term starting from 24 October 2025.
Additionally, the Authority recently announced the vacancy for the Director General/Chief Executive Officer position, with the applications closing on 6 February. The new DG will be responsible for overseeing the operations and the implementation of Kenya’s new regulatory framework.
A pivotal moment for the industry
As the countdown to a new era approaches its end, Kenya’s gambling industry is on the cusp of a pivotal moment in terms of how it is regulated. The takeover is not just a matter of a name change or a bureaucratic adjustment for industry players. It is, rather, a sign that there is a wider desire to modernise the manner in which the industry is regulated, to better protect consumers, and to bring it in line with international best practice.
