House Bill 1038 (HB 1038), introduced on 1 December, 2025, directs the Indiana Gaming Commission to accept applications and proposals for an owner’s licence to operate a casino in Allen County. The introduced text states that the Commission “shall accept applications and proposals” to award a casino licence in the county, explicitly referencing Allen County and potential sites within Fort Wayne.
Legislative records show that HB 1038 received a first reading and was referred to committee on the day of introduction. No amendments, fiscal notes, hearings or further actions have been recorded since.
Also, a second piece of legislation introduced during the same legislative session, Senate Bill 70 (SB 70), addresses riverboat casino relocations more broadly. Unlike House Bill 1038, the bill does not reference Allen County, Fort Wayne or any specific locality. Instead, it sets out general provisions under which existing riverboat casino licence holders may seek approval to relocate operations within Indiana.
SB 70 advanced procedurally, with a committee amend-do-pass adopted on 10 December, followed by reassignment to the Appropriations Committee. Legislative records do not show published fiscal notes or additional amendments beyond the committee stage.
Regulatory framework
Casino gaming in Indiana is regulated by the Indiana Gaming Commission, which oversees licensing, compliance and enforcement for riverboat and land-based casino operations. Any new casino licence or relocation requires legislative authorisation before the Commission can initiate a competitive application and review process.
If enacted, HB 1038 would require the Commission to solicit and review applications specific to Allen County. SB 70 would modify the framework governing relocations of existing licences but does not direct the Commission toward any particular county. No Gaming Commission notices, solicitations or regulatory filings related to casino applications in Allen County have been issued, according to publicly available records.
