Argentina sets 60-day deadline for online betting registration

The Revenue and Customs Control Agency (ARCA) has redefined the Indirect Tax on Online Betting regime in Argentina to provide greater predictability for operators and intermediaries. As of 25 November 2025, registration in the Online Control Register will have a maximum response period of 60 days.

A more organised system for the online betting tax

With General Resolution 5791/2025, recently published in the Official Gazette, ARCA amends General Resolution 5,228, which regulates the indirect tax in force since the enactment of Law 27,346. In addition to streamlining the collection process, it updates the list of foreign operators and sets clear deadlines for registration in the Online Control Register of the Betting System.

This change follows ARCA’s identification of the need to offer industry stakeholders a more predictable mechanism for meeting tax obligations related to online or digital gaming. The agency thus acts to ensure that operators and platforms can adjust their systems without surprises, while the authorities maintain efficient oversight.

Deadlines and automatic update of working days

The amended Article 6 now establishes that if a payment due date falls on a non-business or public holiday, it will be postponed to the next working day. According to the resolution, this seemingly simple adjustment helps ensure smooth compliance and removes uncertainties.

ARCA also confirmed that the list of foreign operators or organisers, liable or subject to the tax, will be published and updated on its institutional microsite. Payment intermediaries acting as withholding agents must consult this list to verify whether the applicable rates should be applied.

Online registration and deadlines established by RG 5791/2025

The key innovation for operators lies in Article 16, which introduces a maximum registration period in the Online Control Register of the Betting System: ARCA will have 60 consecutive days to process the request. This period will begin once the regulatory body of each jurisdiction in Argentina validates it, or from the date of submission, whichever is later.

Additionally, the resolution specifies that licensing authorities use their Tax Code on the digital platform to submit any modifications to an operator’s licence. The countdown will be halted until the necessary information is provided if ARCA asks for further material in order to assess the application.

According to ARCA, this measure will allow all parties involved to know the registration terms and applicable rates with certainty, avoiding delays or ambiguities affecting betting platforms and their users.

Transparency through updated data on Argentine online gaming

Simultaneously, the “Juegos de Azar y Apuestas”, a microsite on their website, will update a list of licensed operators. The firm name, tax identification number (CUIT), certificate validity, registered domains, applicable rate, and jurisdiction are just a few of the facts that will be included. The purpose of this disclosure is to facilitate public monitoring of regulatory compliance by encouraging increased openness in the industry and in tax control.

According to Article 19, ARCA will conduct routine evaluations to make sure that operators follow the law and, specifically, that they hire more workers in order to continue earning tax advantages at lower rates.

Furthermore, registered taxpayers have 15 consecutive days under Article 20 to file complaints through the online service regarding rejections, withdrawals from the register, or assigned rates. This is a step forward in regulation as it gives operators a formal route and defined processes in case of a dispute.

The new regime reflects ARCA’s attempts to find a balance between revenue collection and the industry’s demand for certainty, especially in a dynamic and growing sector like digital betting.

The goal of this regulatory framework is to strengthen the oversight of online activities within a regulated and monitored environment while making it easier for operators and platforms to adapt technologically and administratively.
